Tree Frog Design Terms and Conditions

Quotations: All prices quoted are based on work specified in the quote (or the verbal instructions given at time of order). Quotes are valid for a period of 14 days from their date. Quotes will be deemed accepted upon the Customer making an Order.

Prices quoted are based on the current cost of production, (materials, labour etc.) and are subject to amendment by Tree Frog Design before or after acceptance of the quotation to meet a variation in the cost of production between the date of quotation and the date of execution of the order, provided there is no unreasonable delay on the part of Tree Frog Design.

Proofing: When accepting artwork proofs, the Customer is held fully responsible for accepting all content. This includes design, spelling, grammar and quantity. It is the Customer responsibility to request another copy if the proof is difficult to read or if changes are required. The final accepted proof is what will be printed.

Your Quotation includes provision for up to 3 revisions, Tree Frog Design reserves the right to charge for revisions in addition to this number.

Revisions after the final artwork has been approved will incur an additional fee.

Colour Variation: Due to different monitor setups and calibration, the colours you see on the monitor are not always an accurate representation of what the printed result will look like. If colour is a critical design component Tree Frog Design recommend the Customer inspect a physical proof prior to printing. Tree Frog Design can provide a colour matching service although additional costs are involved.

With CMYK (Full Colour) jobs colours can vary from print to print run and as such small variations are inevitable, Tree Frog Design recommends printing using spot colours if slight colour variation is something the Customer wishes to avoid.

Colour can also vary depending on stock and finish, ie. matt or gloss laminated and on heavier stocks.

Payment: All Invoices shall be paid COD unless prior arrangements are agreed with Tree Frog Design. Any credit arrangements will require an Account Application form to be completed and approved by Tree Frog Design. Account terms are strictly 30 days from Invoice.

Tree Frog Design may request a deposit be paid to cover initial costs, in this case a deposit of 50% is payable unless otherwise agreed. In the case of larger jobs such as brochures, corporate profiles etc. costing will be tracked with progress reports and reviewed estimates if necessary. Progress payments for larger jobs will be at 2 weekly intervals based on work completed to date.

Printing Quantities: Tree Frog Design will use its best endeavours to deliver the correct quantity ordered however quantities will at all times be considered estimates only and can vary by as much as 5-10% above or below specified quantities.

Copyright: Copyright in all artistic and literary works authored by Tree Frog Design shall remain the property of Tree Frog Design until the total amount payable has been paid and transfer of copyright has been agreed by both Tree Frog Design and the Customer. The Customer warrants to Tree Frog Design, that the Customer has copyright in or a licence to authorise Tree Frog Design to reproduce all artistic and literary works supplied by the Customer to Tree Frog Design for the purpose of the Order. The Customer expressly authorises Tree Frog Design to reproduce all and any of such works for the purposes of the Order.

The Customer indemnifies and agrees to keep Tree Frog Design indemnified against all liability, losses or expenses incurred by Tree Frog Design in any way directly or indirectly connected with any breach of copyright in materials supplied by the Customer.

Goods and Services Tax: All prices quoted by Tree Frog Design are exclusive of GST unless specifically stated that the price is ‘GST Inclusive’.

Cancellation of Work: The cancellation by the Customer of any work, for any reason whatsoever, for a period of thirty (30) days, entitles Tree Frog Design to payment in full for the work completed up to the cancellation date.

Delivery: Tree Frog Design shall not be liable for insurance, freight or loss or damage to goods in transit incurred in delivery.
